French blogger fined by court over her reviews high ranking in Googles SERPs

A French judge has ruled against a blogger because her scathing restaurant review was too prominent in Google search results.

The judge ordered that the post's title be amended and told the blogger Caroline Doudet to pay damages.

Ms Doudet said the decision made it a crime to be highly ranked on search engines.

The restaurant owners said the article's prominence was unfairly hurting their business.

Ms Doudet was sued by the owner of Il Giardino restaurant in the Aquitaine region of southwestern France after she wrote a blogpost entitled "the place to avoid in Cap-Ferret: Il Giardino".

According to court documents, the review appeared fourth in the results of a Google search for the restaurant. The judge decided that the blog's title should be changed, so that the phrase: "the place to avoid" was less prominent in the results.

The judge sitting in Bordeaux also pointed out that the harm to the restaurant was exacerbated by the fact that Ms Doudet's fashion and literature blog "Cultur'elle" had around 3,000 followers, indicating she thought it was a significant number.

'Perverse' "This decision creates a new crime of 'being too highly ranked [on a search engine]', or of having too great an influence'," Ms Doudet told the BBC.

"What is perverse, is that we look for bloggers who are influential, but only if they are nice about people," she added.

The judge told Ms Doudet to amend the title of the blog and to pay €1,500 ($2,000; £1,200) in damages to the restaurant, as well as €1,000 to cover the complainant's costs.

Caroline Doudet Blogger In her article, which has now been deleted, she complained of poor service and what she said was a poor attitude on the part of the owner during a visit in August 2013.

The owner took issue with the whole article. However, the judge limited her decision to its title.

The restaurateur did not respond to the BBC. But, according to the website Arrêt sur Images, she said: "Maybe there were some errors in the service, that happens sometimes in the middle of August - I recognise that.

"But this article showed in the Google search results and did my business more and more harm, even though we have worked seven days a week for 15 years. I could not accept that.

"People can criticise, but there is a way of doing it - with respect. That was not the case here."

'Weeks of anguish' A French lawyer and blogger who writes under the pseudonym Maître Eolas, said: "It seems to me that the judge did not understand the technical issues." He added that, in French law, this type of decision would not create legal precedence.

Under French law, a judge can issue an emergency order to force a person to cease any activity they find to be harming the other party in the dispute.

The summary decision is intended to be an emergency measure to protect the person deemed to be a victim and can be overturned or upheld if the parties go to a full hearing.

In order to issue the order under French law, the judge has only to identify a wrong on the defendant's part, a negative effect on that of the appellant and a causal relationship between the two.

Ms Doudet said she did not believe she will appeal because she did "not want to relive weeks of anguish".

Ms Doudet added that, because the decision was taken at an emergency hearing, she did not have time to find legal representation, so had represented herself in court

I want to share a non-domain investing related resource that I think you will find valuable. Each day, MarketingLand.com shares a daily recap called “Marketing Day,” which contains links to popular articles from within its website and from a variety of other websites. This resource is a must read for me every afternoon, and I recommend that you add it to your list of reading materials. The top section of the Marketing Day article contains links and the introduction to articles that appeared on the Marketing Land website during the day. These articles are followed by links to articles posted on other websites that cover a variety of topics, including domain investing (under the “Domaining” heading). DomainInvesting.com articles have been listed under the Domaining heading many times, and I always appreciate it when they link to my blog.

Some of the topics that are also covered in the Marketing Day report include:

I think it’s great that MarketingLand highlights domain name related articles, but I find more value in the other articles that I probably wouldn’t have read had it not been for this recap.

Game of Thrones Ice and Fire: A Foreshadowing aired tonight on HBO, treating fans to an in-depth look at the upcoming drama in season 4.

Though the premiere of Game of Thrones season 4 is still several months away, HBO is sparing no effort in making sure that the fanbase is good and ready for the upcoming season.

To that end, the network aired a 15-minute promotional featurette tonight titled Game of Thrones Ice and Fire: A Foreshadowing. The new video is the longest look at Game of Thrones season 4 that has been released so far, going behind the scenes of the series and offering an in-depth glimpse at the exciting – and potentially heartbreaking – events in the medieval fantasy series.

Season 4: A Foreshadowing [view]
In addition to new footage and clips from the elaborate production process, Game of Thrones Ice and Fire: A Foreshadowing featured many members of the cast answering questions from fans. New characters – such as the fiery Oberyn Martell, Prince of Dorne – were introduced, and the 15-minute video also made no secret of the hardships that lie in wait for many beloved characters in Game of Thrones season 4.

Game of Thrones is, of course, based on the bestselling fantasy series A Song of Ice and Fire by George R.R. Martin. The show’s fourth season will represent the first that the television adaptation will break away from the one-book-per-season model it has generally followed until now.

Game of Thrones season 4 will largely cover the second half of A Storm of Swords, which offers no shortage of material, especially in the politically-charged setting of King’s Landing. Elements of the fourth and fifth books (A Feast for Crows and A Dance with Dragons) may also be incorporated into Game of Thrones season 4.

So despite a recent blog post quoting Matt Cutts that it will not happen in 2013 Google Page Rank Update HAS occurred .  How do I know ?  I was just checking my google webmaster tools and I noticed a drop of about a dozen backlinks so I wondered whats gone on .  I checked and voila ,  this site has gone up !  I was hoping for more but hey, at least its up up up. Another 2 of my new sites - Pick Your Own and About Stockton on Tees have both gone up too so good day .  That means the value of my website has increased and also its authority in Googles eyes and its     SERPs.

YouTube's new comment system forces you to create a Google+ account, and introduces some problematic features. If you want to hide or change YouTube comments, here are a few options:

With Google's change to YouTube's comment system, you are now required to have a Google+ account in order to post a comment. This has angered many users who would rather continue posting under their current anonymous profile or simply don't want to be forced to create a Google+ account. People are so irate that a petition has been started to bring back the old way of commenting.

Personally, I like Google's attempt to clean up YouTube comments, but what has me worried about this change is the ability it has given users to post URLs in comments.(SEO-tastic)  (I also don't enjoy the limitless character count that's now in effect.) I have two young children who like to peruse YouTube from time to time, and I would rather avoid them stumbling across a link someone posted on YouTube that might lead them to an unseemly corner of the Internet.

Thus, it's time to remove or otherwise change YouTube comments. I have three extensions for the job, for either Firefox or Chrome, and one userscript.

First up, the Chrome extension, Reddit Comments for YouTube. As the name suggests, this extension replaces YouTube comments with a Reddit comment thread that's associated with the video. And if you find there are no Reddit comments for the video, you can toggle between regular YouTube comments and the Reddit comments using the two links at the top of the comments section.

For Firefox users, there are a number of extensions that hide YouTube comments, but many of them do not work with the new G+ comments system. One extension that does, is Comment Snob. It's available for Firefox as well as Chrome, although the extension didn't work with either browser on a Mac, and only with Firefox on a Windows 8 machine.

Comment Snob lets you set a variety of rules to filter YouTube comments. You can filter out comments with profanity, spelling mistakes, excessive punctuation, ALL CAPS, and so on. The extension also blocks comments with certain keywords or phrases of your choosing. Alternatively, you can check a box to simply hide all comments.

Since I had some issues with Comment Snob, especially using Chrome, I wanted to find a Chrome extension that just hid YouTube comments. What I found was Turn off Youtube Comments Toggle. It hides comments by default but adds a Comments link (between About and Share below the video) which lets you unhide and hide comments.

Lastly, there is a userscript called Toggle Youtube Comments. With it enabled, it hides YouTube comments along with some other elements on the page such as the footer, making the page look a bit of a mess. And its behavior is a bit erratic.

The Toggle userscript for Firefox adds a Comments link next to the About link below the video player that lets you toggle comments on and off. With Chrome, the button goes missing (Windows 8) or is present but doesn't do anything (OS X). Thus, your only option for toggling comments in Chrome is to disable and enable the extension from Chrome's extensions page. Also, the Comments link goes missing on any video page you arrive at from a related videos link.

At any rate, those are your current options as I see them. If you find an extension that you find useful in combating YouTube's new comment system, please share in the, well, comments below.

Matt Cutts discusses whether or not all comment links are spam and suggests that people always use their real name when leaving a comment. He also mentioned that if these links make up too much of your link profile then it could be looked at as a link scheme. The main takeaway is to not use a keyword as your name when leaving a comment, even if the comment is on topic and adds value to the conversation.

Google’s Matt Cutts: No More PageRank Updates This Year!!

Google’s head of search spam, Matt Cutts, said on Twitter Oct 6 that Google won’t be pushing out a new Google Toolbar PageRank update this year.

Niels Bosch asked on Twitter if we should expect an update to PageRank before 2014. In response to that, Matt Cutts said, “I would be surprised if that happened.”

It has now been 8 months since the last Google Toolbar PageRank update. In fact, the last update was on February 4, 2013 and honestly, I think PageRank is finally dead – at least the Toolbar PageRank.

I’d be surprised if there was another Toolbar PageRank update ever. Maybe Google will do one next year and then let it quietly go away forever.

Over the years, support for PageRank has dropped. Google never offered a Google Toolbar for Chrome or any add-on to show PageRank values. Google dropped the Google Toolbar for Firefox in June 2011. Internet Explorer is the last browser to still have a PageRank display offered by Google, but the data that flows into that display hasn’t been updated for over six months.

When we asked Google two months ago about when the next update would come, Google had no comment.

Earlier this year, Google said that PageRank in the toolbar wouldn’t be going away:
